WARRANTY AND LIMITATION OF LIABILITY                   GRAY MARKET   Alert

1. OMS® warrants to the purchaser that goods sold by OMS® to the purchaser will be free from manufacturing defects in materials and workmanship for a period of one (1) year after the date of purchase except where otherwise noted. Closeout/Clearance items will be sold "as is".

2. EXCEPT AS EXPRESSLY SET FORTH IN SECTION 1 "WARRANTY AND LIMITATION OF LIABILITY", COMPANY MAKES NO WARRANTIES TO THE PURCHASER, WRITTEN OR ORAL, EXPRESS, IMPLIED OF STATUTORY, IN ANY MANNER OR FORM WHATSOEVER INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR USE OR PURPOSE, WHICH ARE HEREBY EXPRESSLY DISCLAIMED.

3. The warranty applies only to goods that have not been subject to abuse, misuse, neglect, improper installation or alteration after delivery to the carrier for shipment to the purchaser and are accompanied by Original proof of purchase. At OMS’® request, the purchaser shall return goods to OMS® at its Middletown, New York, office for verification that the warranty set forth in these terms and conditions as limited by this paragraph is applicable. Any such returns are subject to the provisions in the RETURN POLICY Section.

4. In the event OMS® determines that the warranty set forth above in #1 of this Section are limited by #3 in this Section is applicable to any goods, OMS® shall, as the purchaser’s sole remedy, replace, repair or at OMS’® sole discretion, issue to the purchaser a credit for an amount not to exceed the original purchase price more than one (1) year after OMS’® sale of the goods involved to the purchaser or in the case of OMS Closeout/Clearance items are sold "as is". In no event shall OMS® be liable to the purchaser for a special, incidental or consequential damages. OMS® shall have no liability to the purchaser for any delay or failure in carrying out its obligation to the purchaser for reasons beyond OMS’® control, including without limitation, acts of God, war, natural disasters, labor disputes, changes in or compliance with laws, regulations or governmental policies and shortages of supplies and services. OMS® may extend delivery until any such cause of delay has been removed, or at its option, cancel the undelivered portion of any order so affected without liability to the purchaser, except for the return of any payment made by the purchaser to OMS® with respect to any undelivered portion of the order so canceled.

5. EXCLUSIONS:
BULBS: HID LIGHT BULBS CARRY NO WARRANTY FROM OMS®.
BATTERIES: HID battery packs carry a 3-month warranty after date of purchase. CR123A batteries and 9V batteries are not warranted.
OXYGEN CELLS: Carry a 6-month warranty after date of manufacture.
PLB CANISTER: The PLB canister is warranted to be waterproof for a period of 1 year. In no event shall OMS be liable to the purchaser for special, incidental or consequential damages.

WARNING: Ocean Management Systems Inc. will not be responsible for any injuries or death due to the use of unapproved Oxygen Sensors in OMS Oxygen Analyzers.

For example:

Oxycheq Oxygen Sensors Model numbers: R33D1MP and R33D1M have not been tested for use in s OMS Oxygen analyzers and are therefore: not authorized for use by OMS and b. Void the OMS warranty. Additionally use of these sensors may result in inaccurate readouts.

WARNING: Sale of any OMS® products are intended for sale to and use by a diver trained by a recognized training agency. Use of any life support equipment such as SCUBA diving equipment when used by an untrained person could result in personal injury or death.

What is "Gray Market"?
Generally, a manufacturer works with a single International Distributor who can sell, support and honor warranty claims for OMS products in a given country. The International Distributor usually has local dealers who resell the imported products; this is called a "distribution channel". Gray Market refers to merchandise that is either imported or sold by methods other than these normal channels or OMS products purchased and imported by individuals. For example if you lived in the United Kingdom, and purchased an OMS product from Singapore or any other country for that matter the OMS product(s) would be considered to be gray market goods. For local safety regulations and certifications (FCC, CE, UL, etc.) and government requirements a manufacturer or the distributor provides special packaging (manuals in the appropriate language, power cables designed for the local receptacle, etc.) and product engineering designed to meet local codes. OMS also has service and support agreements with the authorized International Distributor. Gray Market items are not designed to be sold in a particular country and while supported by the authorized International Distributor will be done so at their sole discretion and at a fee. Because these items may not designed for a particular market they may not function properly, or the authorized International Distributor may not be equipped to provide service, support or software.
With the opening of international borders and the use of the Internet to sell goods, Gray Market equipment has become extremely common in the SCUBA consumer marketplace. Many different types of equipment are offered for sale internationally without the proper documentation and consumers do not always know what they are purchasing. Because the "out of country" resellers' cost may be less they may be able to sell Gray Market items for less. Unfortunately this price savings is only on the initial purchase; because service and support is more difficult to obtain it may end up costing the consumer more in the long run.

How do I know if my OMS product is "Grey Market"?
If the deal was just too good to be true, it probably was. One of the first indicators that a piece of OMS merchandise might be Gray Market is if the price is considerably less than most other resellers in your country and the product was purchased outside of the country that you reside in.

What does owning a "Gray Market" OMS product mean to you?
OMS authorized International distributors are not obligated to provide any technical (technical support is with the dealer that you purchased the product from) or warranty support on Gray Market items. OMS gray market products need to be returned to the dealer in the country in which the goods were purchased or you need to discuss warranty or other repairs with the distributor in your country. These repairs will be at charge. While OMS USA will perform warranty repairs on gray goods it is the responsibility of the party possessing the goods to pay all freight charges, insurance, duties, taxes etc. to and from OMS and to provide proof of purchase.
